Tukalos Terms of Service
Effective date: October 2, 2026
These Terms of Service ("Terms") are an agreement between you and Tukalos, based in Toronto, Ontario ("Tukalos", "we", "us"). They apply when you use the Tukalos app at app.tukalos.com and the website at tukalos.com (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Tukalos.
1. What Tukalos is
Tukalos is a local marketplace. It helps people and businesses close to each other connect: someone posts what they need or what they have, a nearby person or business responds, and the two arrange a pickup.
- Tukalos is a meeting place, not a store. We don't own, sell, inspect, store or deliver the items or help offered on Tukalos. Each exchange is between the two people (or businesses) involved.
- We don't check the quality, safety, legality or description of items, and we don't vet users beyond what's described in these Terms.
- Right now, Tukalos is open in Scarborough, around Markham Road and Ellesmere Road, for pickup only.
2. Who can use Tukalos
- You must be at least 18 years old and able to enter a binding contract.
- You can have one personal account. You may create it as an individual or as a business. If you register for a business, you confirm you're allowed to act for it, and the business is bound by these Terms.
- Give accurate information and keep it up to date. You're responsible for everything done through your account. Keep your password private, and tell us right away at hello@tukalos.com if you think someone else is using your account.
3. Posting and messaging
When you post, message or review, you agree that:
- Your posts are honest and accurate: real items or help, a fair description, and a price you'll honour.
- You have the right to offer what you post, and the photos are yours or you're allowed to use them.
- You won't post anything on the items not allowed list (section 9), or anything illegal, misleading, hateful, harassing, sexual, violent or spam.
- You'll keep conversations about an exchange inside the Tukalos chat until you've matched, and you won't use Tukalos to send people elsewhere to pay.
You keep ownership of what you post. You give Tukalos a non-exclusive, royalty-free licence to host, display and share it only to run and improve the Service (for example, showing your post to people nearby). This licence ends when you delete the content or your account, except for copies we must keep for legal, safety or record-keeping reasons.
We may remove posts, messages or reviews that break these Terms.
4. Locations and meeting safely
- Posts show only an approximate location (a general neighbourhood). The exact meeting spot is shared only between the two matched people, in the chat.
- Tukalos suggests busy public places for handoffs. We strongly encourage you to use them, meet in daylight where possible, and trust your instincts. If anything feels wrong, leave.
- You're responsible for your own safety and for following the law during any meetup. Tukalos isn't present at handoffs and can't guarantee anyone's behaviour.
- In an emergency, call 911.
5. Matching, statuses and cancelling
Each exchange moves through clear steps: Posted → Matched → Paid (for paid items) → Completed, or Cancelled.
- Matching means the two people agree to go ahead. For requests, the person helping sets their price after matching, or chooses to help for free.
- Either person can cancel before the exchange is completed (for paid items, before the payment is released). Please cancel promptly and politely if plans change.
- Repeated no-shows or last-minute cancellations may lead to limits on your account.
6. Payments and fees
6.1 How paying works
- Early test period: while Tukalos is being tested in Scarborough, payments in the app run in Stripe's test mode. No real money is charged, held or paid out, so paid exchanges are practice only. We'll tell you in the app before real payments begin, and the rest of this section applies from then.
- Payments are made inside the Tukalos app and processed by our payment partner, Stripe. Tukalos never sees or stores your full card number.
- The person receiving the item pays. They pay the item price plus a 5% Tukalos service fee, shown before they pay.
- When the buyer pays, the money is held, not taken (an authorization). It is only charged when the buyer taps "I got it · Release payment" after the handoff.
- If the exchange is cancelled before release, the hold is released and the buyer isn't charged. Card holds usually last about 7 days. If a payment isn't released in that time, the hold ends automatically, the buyer isn't charged, and the post reopens.
- The minimum price for a paid item is $1. All prices are in Canadian dollars.
- Free items have no fees and skip payment.
6.2 What sellers receive
- When the buyer releases the payment, the seller receives the item price minus a 5% Tukalos service fee. Payouts are sent by Stripe to the seller's bank account on Stripe's payout schedule.
- To receive payments, sellers must set up payouts in the app and give Stripe the information it requires (such as name, date of birth, address and bank details). Stripe may ask for more information or pause payouts to meet its legal obligations.
- Stripe terms for sellers: payment processing services for sellers on Tukalos are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (together, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to sell on Tukalos, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of Tukalos enabling payment processing through Stripe, you agree to give Tukalos accurate and complete information about you and your business, and you authorize Tukalos to share it, and transaction information related to your use of the payment processing services provided by Stripe, with Stripe.
- Tukalos as payment agent: when a buyer pays through Tukalos, Tukalos receives that payment as the seller's limited agent. Once the buyer's payment is released, the buyer's obligation to pay the seller for that item is satisfied.
6.3 Fees
- Tukalos's fees are 5% from the buyer and 5% from the seller on paid items. Stripe's own processing costs are covered by Tukalos out of these fees.
- We may change our fees. We'll give you notice in the app or by email before the change applies, and it will never apply to an exchange that's already been paid.
- You're responsible for any taxes that apply to what you sell.
6.4 Refunds and problems
- Because buyers only release payment after they get the item, most problems can be solved before any money moves: don't release the payment, and cancel instead.
- If something goes wrong after release (for example, the item was very different from its description), contact us at hello@tukalos.com within 7 days. We'll look at the chat and any evidence, and we may, at our discretion, refund the buyer and recover the amount from the seller's future payouts.
- If a buyer disputes a charge with their bank (a chargeback), we'll use the information in Tukalos to respond, and the seller agrees to help. If the dispute is lost because of the seller, we may recover the amount from the seller.
7. Reviews, reports and blocking
- After a completed exchange, each person can leave a review. Reviews must be honest and about that exchange. Reviews are public on the person's profile.
- You can report a person or post and block anyone. Blocked people can't see your posts or message you, and active unpaid matches between you are cancelled. The other person isn't told.
- We review reports and may warn, limit, suspend or remove accounts, or remove content. We may share information with police when required by law or when someone's safety is at risk.
8. Rules for everyone
You agree not to:
- break any law, or help someone else do so;
- harass, threaten, discriminate against or mislead anyone;
- create fake accounts, impersonate someone, or post fake reviews;
- try to get around Tukalos's fees, or ask people to pay outside the app for an exchange arranged on Tukalos;
- collect other users' information, or send spam or advertising;
- interfere with the Service, copy it, use bots or scrapers on it, or try to access accounts or data that aren't yours.
9. Items not allowed
You may not post, offer or request:
- Alcohol, cannabis, tobacco or vaping products, or drug paraphernalia
- Medications (prescription or over-the-counter), medical devices that need a prescription, or illegal drugs
- Weapons, including firearms, ammunition, replica guns, knives meant as weapons, pepper spray and explosives (including fireworks)
- Stolen, counterfeit or knock-off items
- Hazardous materials (for example, chemicals, flammable gases, recalled products)
- Animals and live animals
- Adult content or services, or any service that isn't legal in Ontario
- Personal documents (for example, IDs, passports, tickets that can't be resold), gift cards, prepaid cards or money
- Food that isn't sealed and labelled from a business or a recognized maker
- Anything else that's illegal to sell or give away in Ontario or Canada
We may update this list and remove posts that break it.
10. Our role and responsibility
- Tukalos provides the Service "as is" and "as available." We work hard to keep it running and secure, but we can't promise it will always be available or error-free.
- We aren't responsible for the items, help, behaviour, posts or messages of users, or for what happens at a meetup.
- To the extent the law allows, Tukalos and its directors, employees and partners won't be liable for indirect, incidental, special or consequential losses (such as lost profits or data). Our total liability to you for any claim related to the Service is limited to the greater of $100 or the fees you paid Tukalos in the 12 months before the claim.
- Nothing in these Terms limits any rights you have under consumer protection laws that can't be limited or waived.
- You agree to compensate Tukalos for losses and reasonable legal costs caused by your breach of these Terms or misuse of the Service, to the extent the law allows.
11. Ending your account
- You can stop using Tukalos at any time, and ask us to delete your account at hello@tukalos.com.
- We may suspend or close your account, or remove content, if you break these Terms, if required by law, or to protect users or Tukalos. Where reasonable, we'll tell you why.
- Exchanges that are already paid will be completed or refunded fairly. Sections that by their nature should continue (such as payments owed, section 10 and section 13) keep applying after your account ends.
12. Changes to these Terms
We may update these Terms as Tukalos grows. If a change is important, we'll tell you in the app or by email before it takes effect. If you keep using Tukalos after that, the new Terms apply. If you don't agree, you can close your account.
13. Law and disagreements
- These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
- If there's a disagreement, please contact us first at hello@tukalos.com so we can try to fix it. If we can't, the courts of Toronto, Ontario have jurisdiction, unless consumer protection law gives you the right to go to court elsewhere.
14. Other terms
- These Terms and our Privacy Policy are the whole agreement between you and Tukalos about the Service.
- If part of these Terms can't be enforced, the rest still applies.
- If we don't enforce a part of these Terms right away, we can still enforce it later.
- You can't transfer your account or these Terms to someone else. We may transfer them if Tukalos is reorganized or sold, and we'll tell you if that happens.
